Contract variations in Queensland
What the Queensland Building and Construction Commission Act 1991 (Qld) asks of a variation, and a form that follows it. Fill it in below — the document uses the QLD wording.
What the law says
- The builder must not start the varied work before the owner agrees to the variation in writing (Schedule 1B, section 40(5); 20 penalty units).
- The owner must get a copy in writing before the earlier of 5 business days after the agreement and the start of the varied work (section 40(2)); it may be given by email (section 40(3)).
- The document must be legible, describe the variation, show the date of the request, estimate any delay, state the change to the contract price or how it will be worked out, and say when an increase is paid or a decrease accounted for (section 41(2)).
- An increase cannot be required to be paid before the varied work starts (section 41(3)).
- The rules apply to regulated contracts over $3,300, at both levels: level 1 under $20,000, level 2 at $20,000 or more (Schedule 1B, sections 6 and 7; QBCC Regulation 2018, section 45).

What the document prints for QLD
This is a variation document under sections 40 and 41 of Schedule 1B to the Queensland Building and Construction Commission Act 1991 (Qld). The builder must not start the varied work before the owner agrees to it in writing, must give the owner a copy before the earlier of 5 business days after the agreement and the start of the varied work, and cannot require an increase in the contract price to be paid before the varied work starts.
Besides the parties, site, description and priced lines, the form asks for the date the variation was asked for; the estimated delay, if the completion date moves; when an increase is paid or a decrease accounted for.
