Contract variations in New South Wales
What the Home Building Act 1989 (NSW) asks of a variation, and a form that follows it. Fill it in below — the document uses the NSW wording.
What the law says
- Any agreement to vary a home building contract must be in writing, signed by or on behalf of each party (Schedule 2, Part 1, clause 1(2)).
- That term applies to every contract covered by section 7 or 7AAA — any job over $5,000 including GST — with the exceptions in section 7AA(1A), such as a contract with a developer (Schedule 2, Part 1, clause 1(3); Home Building Regulation 2014, clause 5).
- The full written-contract rules apply to contracts over $20,000 (section 7); jobs over $5,000 have their own shorter rules (section 7AAA).
- The variation clause does not state when the owner gets a copy; a copy of the contract itself is due within 5 clear business days (section 7B).

What the document prints for NSW
This variation to the parties' building contract is put in writing and signed by or on behalf of each party, as clause 1(2) of Part 1 of Schedule 2 to the Home Building Act 1989 (NSW) requires.
The form asks for what every VaryPro document needs: the parties, the site, a description and the priced lines.
