1. Who we are

VaryPro (varypro.com) is run by THE FROLIC APP PTY LTD (ABN 61 697 066 265). In these terms, "we" and "us" mean that company, and "you" means whoever uses VaryPro — the person who fills in and sends a variation, and the person who signs it.

2. What VaryPro does, and doesn't

VaryPro prepares a contract variation document from what you enter, emails it to the other party with a link to sign, records each signature and the signing record, and emails the signed PDF to both parties.

We are not a party to your building contract or to the variation. We don't check what you enter against your contract, and we don't give legal advice. You are responsible for what your document says and for meeting the rules that apply to your contract. The state pages summarise what each state's law says about variations; they are a guide, not advice.

3. Paying

• Prices are in Australian dollars, include GST, and are shown before you pay. You pay by card through Stripe.
• You can buy one document or twenty. A document is used when it is sent. Documents you have paid for and not used stay with the email address you paid with.
• Your tax invoice is emailed to you when you pay.
• The person who signs a variation you send never pays anything.

4. If something goes wrong

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. If a document you paid for doesn't reach the other party because of a fault on our side, tell us and we will send it again or refund what you paid for it.

5. Signing

Each person who signs agrees to sign electronically by ticking the consent shown above the signature box. When you sign, we record your typed name, your drawn signature, the time, your internet address and your device (browser) details, and print them on the signing record. By signing, you agree to that record being made and shared with the other party.

6. Signing in

You don't need an account to send a variation. Paying creates one against your email address; you sign in with a one-time link we email to that address. Keep your email account secure — anything sent while you are signed in is treated as sent by you.

7. Using VaryPro properly

Don't use VaryPro to send a document you aren't entitled to send, to pose as someone else, to send email to people who have no dealings with you, or to interfere with the service. We can stop a document or end access if you do.

8. Changes

We may change VaryPro, its prices and these terms. A price change never affects a document you have already paid for. The date at the top of this page shows when these terms last changed.

9. Our liability

Nothing in these terms excludes, restricts or modifies a right you have under the Australian Consumer Law. Where the law allows us to limit our liability, it is limited to supplying the service again or refunding what you paid for the document concerned. We are not responsible for the terms of your contract or your variation, or for how the other party responds to it.

10. Law

These terms are governed by the law of Victoria, Australia.
