QBCC variation form, filled in and signed online

What Queensland's Act asks a variation document to say, which QBCC form goes with your contract, and the same contents filled in online.

QBCC's variation form is the one-page document that comes with its contracts: Form 5 with the new home construction, level 2 renovation, extension and repair, and natural disaster repairs contracts, and Form 4 with the level 1 renovation, extension and repair contract. Whichever is used, Schedule 1B, section 41(2) of the QBCC Act sets what the document must contain: it must be readily legible, describe the variation, state the date of the request, estimate any delay, state the change to the contract price or how it is worked out, and say when an increase is paid or a decrease accounted for.

The form on this site asks for each of those for a Queensland job, including the date of the request, which the printed Form 5 has no line for.

Not legal advice — your contract's own variation clause matters too.

Section 41(2) against QBCC's Form 5 and this form

Each row is one of the requirements in Schedule 1B, section 41(2), or the copy rule in section 40(2), with how QBCC's printed Form 5 for a level 2 contract and the VaryPro form for Queensland meet it.

The rules the document has to meet

The builder must not start the varied work before the owner agrees to it in writing (Schedule 1B, section 40(5)), and must give the owner a copy of the variation in writing before the earlier of 5 business days after they agree and the start of the varied work (section 40(2)). It can be given personally, by post or by email (section 40(3)). An increase can't be required to be paid before the varied work starts (section 41(3)).

These rules apply to every regulated contract: one priced over $3,300, at level 1 or level 2. Level 2 starts at $20,000 (QBCC Regulation 2018, section 45).

QBCC's Form 5 notes that the contractor can't require payment for an increase before the variation work has been completed. That is stricter than section 41(3), which rules out payment before the varied work starts. The condition in the contract the parties signed binds them, so check which one your contract carries.

Filled in and signed online

QBCC's forms are one-page fillable PDFs, signed and dated by hand, and none of them says anything about signing electronically. On this site the builder fills in the variation, signs it and sends it; the owner signs from the link in their email, on a phone or a computer; and both get the signed PDF, with a signing record at the end that shows who signed and when.

Fill in the variation

  • $9.90 to send it. Filling it in and the preview PDF are free.
  • Both parties sign it. The other party signs from the link we email them, on a phone or a computer — no app, no account.
  • Follows your state's rules. It asks for what your state requires and prints its statement, and the PDF ends with a signing record: who signed, when, and from which device.
